Mediation

Mediation is a conventional, flexible and confidential dispute resolution procedure through which a neutral third party, known as the mediator, helps the parties to reach a freely negotiated settlement between them.

The mediator appointed by the parties or by mizan in accordance with its Mediation Rules is neither a judge nor an arbitrator in that he or she does not have the prerogatives to issue an award or a judgment binding on the parties. Its essential role is to assist the parties and to bring them to find an agreement by their own means to resolve their dispute.

This method of dispute resolution can be an extremely effective conflict management tool and can be used, at the option of the parties, before, during or after the issuance of an arbitral award or a judgment.
